Tim Baker Real Estate Terms & Conditions

As at September 2025

At Tim Baker Real Estate, we believe in being upfront and transparent about our fees and commission structure.

With that in mind, please note, the following commission rates and fees are for residential properties and sections within Christchurch City boundaries only and is for new listing agreements entered into from 8 September 2025.

Commission Rate and Fees

  • Commission Rate: 1.25% + GST of the final sale price. Minimum commission fee of $5,500 + GST applies.
  • Administration Fee: $500 + GST
  • Marketing Costs: Vendor is responsible for all marketing costs, which will be quoted and agreed upon prior to commencement. Marketing costs vary depending on the chosen campaign and will be set out clearly in writing before you agree to proceed.

Example of Commission Payable

If your property sells for $500,000, the commission and fees (excluding marketing) would be calculated as follows:

  • Commission: 1.25% of $500,000 = $6,250.00
  • Administration Fee: $500.00
  • Subtotal: $6,750.00
  • Plus GST at 15%: $1,012.50
  • Total commission (including GST): $7,762.50

This example is for illustration only. The actual commission will depend on the final sale price of your property.

Eligibility

  • Offer applies exclusively to residential properties located within Christchurch City boundaries, listed by Tim Baker and/or Carolyn Baker-Brown from Tim Baker Real Estate Limited.

GST Information

  • All fees and commissions quoted are exclusive of GST unless otherwise specified.

Commission offer validity

  • Commission offer is valid for standard exclusive agency agreements of 90 days. Extension of agency agreement beyond the initial term may require renegotiation of terms and fees.

Payment Terms

  • Commission and administration fees are payable on the date of settlement, unless otherwise agreed in writing.
  • Marketing costs may be invoiced separately and are payable prior to marketing commencement unless otherwise negotiated on a payment plan.

Cancellation & Withdrawal

  • If the property is withdrawn from market or the agreement is cancelled prior to sale, the vendor remains liable for any marketing costs already incurred.
  • No commission or administration fee will be charged if the property does not sell prior to unconditional confirmation of sale received.

Disputes

  • All efforts will be made to resolve disputes amicably. In case of unresolved disputes, parties may seek mediation or resolution through REA (Real Estate Authority) or other relevant bodies.

Other Conditions

  • This offer cannot be used in conjunction with any other commission offers, discounts, or promotions.
  • The terms and conditions outlined above are subject to change unless part of an existing contract.
